Terms & Conditions

1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the SecForm platform, websites at secform.fr and any related services (collectively, the "Service") operated by SecForm ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Definitions
- Customer: the legal entity or individual that subscribes to the Service.
- End User: any person submitting data through a form published by a Customer.
- Customer Data: all data submitted by End Users into Customer forms.
- GDPR: Regulation (EU) 2016/679.
3. Accounts
You must provide accurate, current, and complete information when creating an account and keep your credentials confidential. You are responsible for all activity occurring under your account. Notify us promptly of any unauthorized access.
4. Acceptable use
You agree not to:
- use the Service to collect data unlawfully or without a valid legal basis;
- upload malware, attempt to breach the Service, or probe its security without authorization;
- send unsolicited communications or spam through the Service;
- reverse-engineer, resell, or sublicense the Service except as expressly permitted;
- use the Service to process special-category data (Art. 9 GDPR) without first agreeing additional safeguards with us in writing.
5. Customer Data & data protection
As between the parties, Customer is the data controller and SecForm is the data processor for Customer Data, as defined under the GDPR. Our processing of Customer Data is governed by our Privacy & Data Protection Policy and our Data Processing Addendum (DPA), available on request at dpo@secform.fr. All Customer Data is hosted in the European Union.
6. Fees & payment
Where applicable, Customer agrees to pay the fees set out in the order form or pricing page in force at the time of subscription. Fees are stated exclusive of VAT and other applicable taxes. Late payments may incur interest at the rate set by Article L.441-10 of the French Commercial Code.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by SecForm and protected by intellectual property laws. Customer retains all rights in Customer Data. Customer grants SecForm a limited, non-exclusive licence to process Customer Data solely to provide the Service.
8. Availability & support
We use commercially reasonable efforts to keep the Service available 24/7, subject to scheduled maintenance and force majeure. Support is provided in English and French by email at support@secform.fr.
9. Confidentiality
Each party agrees to protect the other party's confidential information with the same degree of care it uses for its own (and no less than reasonable care), and to use it only to perform its obligations under these Terms.
10. Warranties & disclaimers
SecForm warrants that it will provide the Service with reasonable skill and care. Except as expressly stated, the Service is provided "as is" and we disclaim all implied warranties to the maximum extent permitted by law, including fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, revenue, data, or goodwill. Each party's total aggregate liability arising out of or in connection with these Terms is limited to the fees paid by Customer to SecForm in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Term & termination
These Terms remain in force as long as you use the Service. Either party may terminate for material breach if the breach is not cured within thirty (30) days of written notice. Upon termination, Customer may export its data for thirty (30) days, after which Customer Data will be deleted in accordance with our retention policy.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least thirty (30) days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law & jurisdiction
These Terms are governed by the laws of France. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Paris, France, subject to mandatory consumer-protection rules.
